How does Ontario's rent control work in 2026?
In Ontario, rent control applies only to residential units first occupied before November 15, 2018. For those units, landlords may only raise rent by the government-set annual guideline — in 2026, that guideline is 2.5%. Units first occupied on or after November 15, 2018 are exempt from rent control, meaning landlords can raise rent to any amount between tenancies. However, during an active tenancy, all rent increases require a proper N1 notice served at least 90 days before the increase takes effect, regardless of rent control status.
What's the fastest legal way to handle a non-paying tenant?
The fastest route under the Residential Tenancies Act is to serve an N4 (Notice to End Tenancy for Non-Payment of Rent) on day two after rent is due. The tenant then has 14 days to pay the full amount owing or vacate. If they do neither, you can immediately file an L1 application with the Landlord and Tenant Board. With current LTB wait times, getting a hearing scheduled quickly is critical — which is why filing the moment the N4 period expires is essential. Having a property manager handle documentation and attendance can significantly reduce your exposure.
Can I raise rent above the guideline for new tenants?
Yes — when a unit becomes vacant, you can set rent at any amount for the new tenant, regardless of what the previous tenant was paying. This is called a "vacancy decontrol" and applies to all units in Ontario. Once the new tenancy begins, however, any future increases during that tenancy must follow the guideline (for pre-November 2018 units) or be negotiated and properly noticed. There is no legal requirement to disclose the previous rent amount to a prospective tenant, though the Standard Ontario Lease does require the agreed rent to be clearly stated.
What insurance do I need as an Ontario landlord?
Standard homeowner's insurance is not sufficient for a rental property. Ontario landlords should carry landlord or rental property insurance, which typically covers: building structure, loss of rental income during insured repairs, liability protection (minimum $2M recommended), and vandalism or malicious damage by tenants.
